(07-09-2005 A.D.) to Malpot Karyalaya, Kalanki (Land Registration Office) to register the property in the name of the buyer without receiving payment as per the condition of the tender of date 2062/03/17 B.S. 9) RB bank, Main Branch Kathmandu issued approximately 100% loan (equal to accepted tender value) against the same property (refer to Malpot Karyalaya's tamsuk registration no. 3527 dated 2062-06-06 B.S. registered by bank and buyer) breaching Tender condition and rules of Nepal Rastra Bank (NRB).

10) Letter no. 21/41 dated 2062/06/16 B.S. (02-10-2005 A.D.) of RB bank, Main Branch Kathmandu verifying that the tender amount was deposited by the buyer only after the property was registered in the buyer's name and loan was issued on the same property by RB bank itself on 2062-06-06 B.S. against Tender conditions and rules of Nepal Rastra Bank.

11) Order letters ( date 2065-11-11 B.S. and date 2066-01-15 B.S.) issued by Debt Recovery Tribunal (DRT), Kathmandu , Nepal to Rastriya Banijya Bank (RB Bank) regarding MGI, Kathmandu and important required ordered documents were not presented by RB Bank to DRT despite repeated orders by DRT.

12) RB Bank despite knowing all the machineries were hypothecated to NCC Bank (refer to attachments no. 26, 27 and 29), inorder to conspiringly sell the MGI's property of Kitta No. 266, 267 and 268 , both RB Bank and NCC made an illegal agreement on 2062/02/12 B.S. (May 26th 2005) between themselves regarding machineries after the Stay order was issued by Appeal court on 2062/01/30 B.S. (May 13th 2005) on machineries auction published by RB Bank on 2062/01/01 B.S. (April 14th 2005).

13) After the illegal agreement, NCC Bank was left over with machineries of value of Rs. 3,06,11,043.60 ( Rupees Three Crore six lakhs eleven thousand forty four only) out of Rs. 7,09,32,097.60 ( Rupees Seven Crore nine lakh thirty two thousand and ninety eight only) insured and hypothecated in favour of NBOC (NCC Bank).

14) Supplementary agreement / Insurance Payment Receipt of all machineries of Mahalaxmi Garment Industries and List of all machineries of Mahalaxmi Garment Industries (In Main Building, Branch Hall and New Building) of Rs. 7,09,32,097.60 ( Rupees Seven Crore nine lakh thirty two thousand and ninety eight only ) insured and hypothecated in favour of NBOC (NCC Bank) (as mentioned in GENERAL INDEMNITY FORM OF NBOC date: 05-09-2001)

15) The MOU proposed by RB Bank to Mahalaxmi Garment Industries on 10th May 2004 where in point 2 .2 (g) RB Bank has stated "The party is to provide fresh hypothecation deed on the mill/machines which is already not in hypothecation to NCC Bank." But since all the machinery of MGI were in hypothecation to NCC Bank and belonged to NCC Bank, the industry denied to sign the MOU.

16) Rastriya Banijya Bank (RB Bank), Bishal Bazaar, Branch Office letter challan no. 626 sent to RB Bank, Singha Durbar Plaza on 2058/12/01 regarding detailed description of properties mortgaged by MGI against running loan limit.
